General provisions
Rushingit.com s.r.o. Company Ltd., (IČO: 01960296) located at Kaprova 42/14, Stare Mesto, 110 00 Prague 1, Czech Republic (hereafter also the "Operator"), is the operator of an Internet portal Rushingit.com (hereafter the "Website"), available at (URL) http://www.rushingit.com (the "Service"). Rushingit.com s.r.o. is registered in the Commercial Register, at MC, C 213739 in Prague.
The operator provides to the third parties an access to user interface (the "Service Site"), which is used for inserting and editing advertisements and other data chosen from the menu.
The User is reference to any person who visits the portal Rushingit.com (hereafter the "User, Users").
Client of paid advertising on the Service (the "Client, Clients") is an individual person, a freelancer or a legal entity.
- The Client is registring for an access to the Service sites through which is
allowed to enter the line advertisement on portal www.rushingit.com.
Rushingit.com is a World Wide Web site designed to allow Users/Clients to post ads and/or to view ads posted by other Users/Clients or interact with those Users/Clients. Rushingit.com contains or may contain information, communications, photographs, text, graphics, links, opinions and other material and data collected in a variety of forms that are generally accessible to Users/Clients, including directories and databases, and areas of rushingit.com that can be modified by Users/Clients, such as posting ads.
Rushingit.com does not function as a broker or seller nor is rushingit.com involved in any communication or transaction between buyer and seller.
In no case does the operator provide any compensation to users, sellers, advertisers or third parties. The Rushingit.com advertising website allows advertising only in the form of a so-called "Notice-board", where users communicate with each other only in the form of direct contact (e.g. by providing an e-mail or telephone number). The connection between the user (Advertiser) and the user (Interest) occurs directly. All prices in the ad may be completely different, incomplete, partial, old, invalid, out of date, not updated, obsolete. Users agree on the final price for the advertised item among themselves without the involvement of the Operator. In no case does the Operator find out whether or not any possible trade between users has taken place, and in no case does the Operator find out for what final amount the advertised item could have been offered by the user to another user. The conclusion of such transactions, contracts, agreements and / or arrangements remains the subject of the activities of users and third parties.
1. The client is not authorized to provide an access to the Service sites to any third party based on the client’s registration.
2. The Service is (according to the Operator) the subject for payment, according to the Price list located at the address (URL ) http://rushingit.com/pricing-rushingit-com.
3. Advertisement published by the Client via Service is available to all Users of the World Wide Web through the portal Rushingit.com, as well as other authorized web portals of the Operator or its contructual partners or to websites that are not under control of the Operator.
4. If Client/ User submit a classified ad all of the information will be displayed for everyone to see including the email address, name and other contact details.
Registration and publication of an advertisement
1. Access to the Service sites is possible on the basis of the registration of the Client applying for the Service.
2. During the registration for the Service on Rushingit.com, the Client bounds to provide true, accurate and complete information about himself/herself and about the company he/she represents. If the customer provides any information which is not true, inaccurate, outdated or incomplete, the Operator has the right to suspend, delete or to terminate the Service that the Client applied for.
3. During the registration process, the Client must enter his/her full name or company name, user name, password and an e-mail adress. The Client is solely responsible for the confidentiality of his/her e-mail address and the password, and is fully responsible for all activities that occur within his/her membership number and password. The Operator does not guarantee and is not responsible for any loss or damage resulting from the breach of this agreement.
4. Placing an advertisement on the site is charged and time-limited. After expiry of the time, Registration period may be extended for a fee. The fee for an advertisement for a set period of time is irreversible. The Operator is not in any way responsible for the malfunction and failure to publish an advertisement for any set period of time.
The rights and obligations of the contractual parties
1. Username and password serve for accessing the Service sites. Client is not entitled to provide those information to third parties or attempt to gain unauthorized access and tamper with data on the Service. Client is fully responsible for any misuse of Service sites and/or misuse of his/her username and/or his/her password. Client must not particularly jeopardize technical functionality of Service sites.
2. Within the Service, Client is entitled to publish, edit and otherwise edit only his/her own menu or the menu on the basis of existing intermediary and/or similar contracts with their owners.
3. Client agrees that he/she will provide true, current, accurate and complete information about himself/herself and about the company he/she represents.
4. All the data enters the Client into the Service sites on his/her own account and expenses in conformity with the instructions of the Operator (especially with below specified Rules of advertising)
5. The Client is obliged to mediate business activities
6. Client bounds not to publish any information whose content is in violation of any law or affecting the rights and legitimate interests of third parties. Further he/she bounds that he/she will not made the Operator responsible for any legal rights of third parties that arise on the basis of the publication of Client data entered by him/her via the Service.
7. Client hereby declares that he/she obtained all necessary third parties, trademarks, copyrights, or licences for patents and authorizations, or any other licences or permissions, that he/she publishes on the Portal Rushingit.com
8. Operator reserves the right to remove any information or refuse their publication, if:
the information are in breach of any law
they are contrary to morality or they endanger public order or they harm the rights and legitimate interests of third parties.
contents of information contradict the interests of the Operator or are in conflict with these terms and conditions or below specified Rules of advertising.
9. Client and User hereby represents, warrants and agrees that information (Content, Interactive Area) submitted to Rushingit.com to view on the Rushingit.com not:
- Violate or break any third-party copyright, patent, trade secret, trademark or other proprietary rights, intellectual property rights of any person or confidential information or derivative works with respect thereto, without first obtaining permission from the owner or right holder.
- Contain information with any business, association, institution or other organization for which Client/User are not authorized to claim such a relationship.
- Violate any law, decree or regulation
- Include or fraudulent information or offers, and/or contain material that is prohibited by the law
- Include any unauthorized advertisement
- Contain computer viruses or other destructive devices
- Be harassing, threatening, or cause distress, natural person or legal person.
- Be threatening, abusive, vulgar, hateful, or racially or otherwise objectionable, or otherwise violate valid state, regional, national or international law or regulation.
- Include illegal service of sexual offer/s for money or other consideration
- Include any material that represents or assists in trading with humans.
- Contain pornography, or photographs with genitalia.
- Contain erotic photographs, data or content, etc.
- Include erotic ads, erotic aids.
- Send by post, e-mail, telephone, voice messages or fax messages for harassment of any other product
- Send data that include personal or identifying information of another person
- Post or transmit any information through any phone number or through any contact form on this site that is not honest and accurate.
- Include data that violate federal, state or local fair employment laws, including, but not limited to those prohibited to be sated in any advertisement of employment, preferences or requirements on the basis of race, color, sex, religion, age or disability of applicant
- Send viruses, Trojan horses or other destructive elements
- Include goods intended for promotion and dissemination of opinions of extreme left or extreme right or movement aimed at suppressing human rights and freedoms.
- Contain text, data, photographs and materials that have the character of extremist group
- Include materials, photographs, texts, advertisements promoting the use of firearms, stabbing weapons and/or any weapons.
- Indlude goods which do not actually exist.
- Include a menu of medications and dietary supplements or pharmaceuticals.
- Include (MLM) Multilevel and commission systems.
- Include repeted advertising of the same new items.
- Include Emailing.
- Include counterfeis, copies, imitations.
- Include documents and technical cards.
- Include fuel.
- Include Livechats and work by dancers, hostesses abroad, etc.
- Include contatin such as a dating site and dating ads, etc.
- Include ebooks.
- Include works that subject to fee in advance.
- Include a menu of loans and mortgages and debt relief.
- Include food, food supplements, drinks, beverages and alcoholic beverages and medicines.
- Include cigarettes or any other tobacco product, electronic cigaret, etc and alcohol.
- Counterfeit or stolen goods.
- Include any material with pets and animals and dead animals or parts of animals.
- Send spam or include spam.
- Include / offer Bitcoin and other coins, etc.
- Include personal photos and personal data and third party data.
- Include surveys, etc.
- Include any counseling, exercise, dieting, weight loss, cosmetics, body care and any cosmetics, medical or food products or supplements.
- Include gold bars, silver bars, include gold, diamonts and any precious stones and precious metals.
10. The Operator is not obliged to retain advertisements on Service sites.
11. Client is entitled to „top“ the advertisements once a day. To „top“ the advertisements means their move to the first position in the list of advertisements that are displayed to the user during the search. This is an additional service. The Client is entitled to freely choose the time when he/she will „top“ his/her advertisements, these can be „topped“ gradually. Clients have the same right „to top“ their advertisements. As the Operator gives to Clients the opportunity „to top“ their advertisements at any time during the day, the Operator is not able to guarantee to Clients a minimum period during which the „topped“ advertisement will be the first on the site. Contravention of the service of „topping“ the advertisements is a particularly serious breach of the Terms and the Operator reserves the right for such a breach of the Terms withdraw from the Terms and thus immediately stop to provide the ordered services to the Client without refund. Client may use the highlighting of advertisement that appears tinged when User searches in the list of advertisements on the Service. The Client is entitled to freely choose the time of the day in which his/her advertisements will be highlighted. Highlighting and coloring of advertisements is linked with the duration of validity of the advertisement. The Operator does not guarantee functionality and will not be responsible for failure of „topping“ the advertisements, for failure of coloring of advertisements or the time of publication and/or non-publication of the advertisement.
The client agrees that the fee for the already paid service / package will not be refunded in any way. The fee for the already paid service / package is by no means refunded.
12. By the confirmation of these Terms and Conditions, Client and User agrees that the Operator is authorized to send to the Client and User information materials concerning the operation of the Service or related services, as well as about the products of the third parties.
13. Operator is not responsible for screening, editing, policing, reviewing or monitoring any content in an interactive area. Notwithstanding the above, User/Client agree that Operator reserves the right to monitor all text, photographs, advertisements, public comments and messages, interactive area, to ensure that they are in compliance with these Terms and Conditions. Operator reserves the right to prohibit conduct, communication or content within an interactive area, or to edit, refuse to post, or to remove any Content, in whole or in part if violate the then-standard provisions of this Terms and Conditions.
14. Operator reserves the right to publish reports of fraud or deception that violated this agreement or abused Portal www.rushingit.com.
15. Operator reserves the right, but has no obligation, to monitor the materials posted in any area of the Service. Without prior notice, the Operator has the right to remove such material that violates the law or these Terms and Conditions.
16. In no event shall, the Operator or his representatives, contractors and subcontractors be liable for lost of profits, profits, goodwill or reputation, or any special, indirect or consequential damages resulting from the use of the Rushingit.com website / portal, even if Rushingit.com has been informed or could reasonably have foreseen the possibility of such damage or any special, incidental, or consequential damage arised out of/in connection with these Terms and Conditions.
17. It is the user's/client's responsibility to use good judgement and due diligence when considering the purchase of a boat, property, car, motorbike, cell phone, helicopter, aircraft, furniture, light, sports equipment, electronics, apparel or any property.
18. By posting an ad on the Rushingit.com site, the user grants the operator the right to use this content for the purpose of promoting the portal.
Financial conditions
1. The Operator is entitled to require payment in advance, according to the Price List.
2. The Operator uses a payment gateway and systems of other companies, but does not guarantee the functionality of these systems.
3. Sent payment is non-refundable
4. The Operator is entitled to delete or not publish advertisements of Client in case of outstanding payments or when the Operator is unable to identify the payment. The Operator is authorized to suspend or refuse any order of the Client without giving any reasons and without compensation.
5. Publication, „topping“ of advertisement, highlighting the advertisement is charged according the Price List of the services and is paid in advance by the bank service or other services of other providers.
6. Operator reserves the right to unilateral change of the price of the Services without prior notice. These changes will be published in the administration of the Service at (URL ) http:// www.rushingit.com and such amendment shall come into force on the date of its publication. The Operator is not liable for Client‘s ignorance to changes of the Price List and prices of the Service.
Final provisions
1. Any use of the content of the Server, or its part, for other purposes than those purposes the server is intended for, particularly any distribution of the content of the Service, is prohibited. Any interferences into the technical or factual content of the Service are prohibited. The right to provide backup copies of the materials published on the Server for personal use in compliance with general legal regulations is not affected by this provision. Any other reproduction or modification done by any mechanical or electronic means without prior written permission is prohibited.
2. The operator shall not be liable for any errors or omissions in the information stated in the Portal Rushingit.com, or for any loss or damage of any kind incurred as a result of the use of any information stated on the Portal Rushingit.com.
3. The Operator is not responsible for the quality, origin, delivery, takeover, payment or use of goods and services offered on the portal Rushingit.com.
4. The operator is not responsible for the activities of Rushingit.com users nor for the way they use Rushingit.com. It also has no responsibility for any abuse of server services by users or third parties.
5. The User agrees that the Operator does not bear any responsibility for unauthorized misuse of Rushingit.com website by a third party, as a result of which these unauthorized third party will gain access to the data of the individual users or their accounts and / or to the relevant database. The user hereby declares that he is aware of the risks arising from unauthorized third party interventions above as a result of such interference by unauthorized third party being able to provide access to the data of individual clients or their accounts or to the respective database of the Provider and such data may be used/utilized/abuse by unauthorized third parties or made available to third parties.
6. The User/Users understands that the information, data, images, texts, any information that Inserts / Entries / Publishes on Rushingit.com website or other sections of Rushingit.com website or other automatically generated pages of Rushingit.com may be used third party or other websites / applications, this information may appear in search results such on Google (texts, photos, video, data, ad information and advertiser information, contact and any information, link, etc.), etc. or other third party websites.
7. The Operator shall not be held responsible for the misuse of the User's personal data listed in the advertisement, or by the unauthorized entry into the website by a third person. The user agrees to anonymous use of registration and statistical data.
8. The Operator does not control the content of the Portal Rushingit.com. Operator is not responsible for the accuracy, completeness or currency of the information stated on the Portal Rushingit.com.
9. User/Client agrees that rushingit.com may include various interactive areas, including but not limited to ads. These interactive areas allow feedback to rushingit.com and interaction between Users/Clients. User/Client further understand that rushingit.com does not control the messages, messages through contact form, information, pictures, photos or files delivered to such interactive areas. Operator is not responsible for the content for Content within any interactive area. User/Client recognize that rushingit.com cannot, and does not intend to, screen communications in advance.
10. Portal Rushingit.com may contain links to other websites of Rushingit.com Ltd. or to websites that are not under control of the Operator. In this case, the Operator is not responsible for the content of the websites of the third parties and is not responsible for their use by the User or Client.
11. The Operator is not liable for any damages that happened to the Client or User due to access and use of the Portal Rushingit.com, the Operator is not responsible for damages that happened to the Client or User resulting from downloading any data from the Portal Rushingit.com. The Operator is not responsible for the protection of the Client or User from computer viruses or from the loss of the data of the Client or User.
12. The Operator is entitled to delete any advertisement without any financial or other compensation.
13. Operator may terminate or temporarily suspend User/Client access to all or any part of rushingit.com, without notice, for conduct that Operator believes is a violation of this agreement or any policies or guidelines posted by rushingit.com, or for other conduct which Operator believes, in its sole discretion, is harmful to rushingit.com or other Users/Clients.
14. The Operator does not offer his/her own goods (with the exception of marketing campaigns) and does not participate in any agreements between Users or Clients.
15. It is the buyer's (User's or Client's) duty to inspect a boat, property, car, motorcycle, cell phone, helicopter, aircraft, furniture, light, sports equipment, electronics, apparel prior to purchase and to survey, have it surveyed, or have a broker act on their behalf to confirm that boat, property, car, motorbike, cell phone, helicopter, aircraft, furniture, light, sports equipment, electronics, apparel is as advertised and as desired, that seller has clear title, and that the conditions of sale are satisfactory. It is the seller's (User's or Client's) responsibility to use good judgement and due diligence when considering the sale of a boat, property, car, motorbike, cell phone, helicopter, aircraft, furniture, lights, sports equipment, electronics, apparel. It is the seller's (User's or Client's) responsibility to confirm that all payments have cleared and are non-fraudlent before boat, property, car, motorbike, cell phone, helicopter, aircraft, furniture, light, sports equipment, electronics, apparel or any property is released or changes hands.
16. The Operator does not check the offered goods and does not guarantee the fulfillment of contracts and other agreements between Users or Clients.
17. All information on the Portal www.rushingit.com may be inaccurate, incomplete or out of date,
18. Operator is not responsible for the content of graphic design of the Client’s offers presented on Rushingit.com. The Operator is particularly not responsible for copyright infringement or unfair competition of the Client or User.
19. The Operator does not guarantee the availability and functioning of the Portal Rushingit.com with regard to possible technical problems or regular maintenance of Rushingit.com. The operator is not liable for any damages that may arise to Clients or Users due to such unavailability of Services on Rushingit.com.
20. Operator may discontinue operating rushingit.com and terminate this Agreement/Terms and Conditions without notice at any time for any reason in its sole discretion. In the event of termination, you are no longer authorized to access Rushingit.com (Website, Service, Service Site). Limitations of liabilities set forth in this Terms and Conditions, shall survive.
21. User/Client may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, transfer, commercially exploit or sell any information, software, products or services obtained on the portal Rushingit.com.
22. User/Client give rushingit.com the royalty-free, perpetual, irrevocable, unrestricted, worldwide right and license to use, modify, adapt, publish, reproduce, translate, create derivative works from, distribute, sublicense, perform, and display such Content, in whole or in part, worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed for the full term of any Intellectual Property Rights that may exist in such Content. User/Client also permit rushingit.com to sublicense to third parties the unrestricted right to exercise any of the foregoing rights granted with respect to such Content. User/Client also permit any User/Client to access, view, store and reproduce the Content for personal use.
23. The users agrees to indemnify the Rushingit.com company, its parent or subsidiary companies and their subsidiaries and their respective directors, employees, third parties including fees to legal counsel and agents from any liabilities, claims and expenses, including reasonable fees to legal counsel, resulting from breach of these terms or any law or regulation. Rushingit.com users are obliged to release Rushingit.com company from any claims or lawsuits.
The User/Client is obliged to reimburse the Authorized Persons and the Operator for compensation for incurred damages in case of violation of third party rights. Furthermore, the User is obliged to promptly and conclusively substantiate materials or facts that relate to his authorization to exercise the proprietary copyright in the advertising or advertising used on the Operator's request.
The User / Client / is obliged to pay 2500 EURO (for each advertisement/picture, link, etc.) to the Operator for every minute of published content on Rushingit.com (texts, titles, headlines, pictures, videos, music, links, etc.) that infringes copyright and third parties.
24. Operator reserves the right to change these Terms and Conditions without prior notice. This will be done by publishing of its latest and full version on the Service site, which means that the new Terms and Conditions come into force. If the Client or User uses the Portal Rushingit.com even after change of the Terms and Conditions, it is understood that he agrees with them.
25. When these Terms and Conditions will be violated by the Client or User, the Operator is entitled to apply to the Client or User all penalties in compliance with the laws of the Czech Republic.
26. In cases (In the sense of the provisions of § 1820 par. 1) letter j) of the Civil Code and § 14 par. 1 and § 20d et seq. Act No. 634/1992, for consumer protection.) where the Customer is a consumer in relation to the Portal Operator and a consumer dispute arises which can not be resolved by mutual agreement between the parties, the Customer may submit a proposal for out-of-court settlement of the consumer dispute to the Czech Trade Inspection.
Rules of Advertising:
1. The system is designed for self-insertion, managing and publishing the advertisements..
2. Before entering the the system, the Client must sign in (authorize)
3. The client/ user / advertiser is responsible for the content of the Advertising. The Operator has no responsibility for the content of the advertisement / ad. The advertiser is obligated to adhere to these terms and conditions and the relevant legal regulations when placing the ad.
4. The client / user / advertiser must not attach photos from other retailers (etc.) originally purchased on the merchandise sold.
5. Content of advertising is received in the English language, understandable for English speaking users and in compliance with the rules of American and British English.
6. The Client agrees to put the advertisement into relevant section according to its type and its nature and update the advertisements untill 24 hours, if there is a change in their state or change in information contained in them.
7. When placing the advertisement, the Client agrees to respect and fill in required fields, ie. boxes and description, in the item called description there will not repeated those data that are the subject of the item called box. The Client agrees to state in description only those data which are subject of the boxes and assign the appropriate data into the correct boxes and into the places designed for those purposes and not to publish any contact information to people, companies or websites anywhere else.
8. Client agrees to provide truthful information in the presented offer, including final prices, fees, commissions and photographic documentation and inclusion into the corresponding type, category and subcategory, which is set in the system and corresponds to reality. Photographic documentation must not include logo of the company instead of the photograph of the property. Logo is permitted only as a watermark, which is the part of the photograph of the advertised property (this does not mean an illustrative photo). The Client will not enter or import identical offers of the real estates into the database with different or speculative price or with any nuances in description and parameters.
9. The Client is not authorized to publish the offer of the jobs, cars, motorcycles, boat, helicopters, aircraft, real estate, apparel, phones, furniture, lights, or any property that he/she does not own or for whose offer he/she is not authorized on the basis of the existing intermediary and/or similar contracts with the owners.
10. The Client is aware that if the wants the advertisement to be removed before the expiry of the date of publication, he/she must do so on his/her own expenses on the basis of his/her registration to the Service.
11. Placing the advertisements on Rushingit.com is allowed only to Clients or Users of the age of 18 and older, provided that they have the capability to legal acts in its entirety.
12. Operator reserves the right to check the contents in compliance with the laws of the Czech Republic. In the detail of advertisement, or in the text of advertisement, there is prohibited:
- Publication of written words in capitals (unless the abbreviations or the names are officially written only in capitals)
- Publishing more than one exclamation mark (before exclamation mark must be no gap)
- Writing interrogative, exclamatory and imperative sentences
- Multiple repetitions of words/phrases, excessive punctuation (three dots), "smiley", HTML tags,
- Ending with expressions such as "etc.", "and so on," "..." and their equivalents,
- The use of superlatives and objectively not judgeable expressions or phrases about quality, such as: "The best service...",
- State meaningless phrases like "everything you have ever wanted to know about...", "Come and see...",
- Display the company logo in place designed for the photograph of the property
- Business notification, advertisement or claims about the competition,
- Publish copied and unauthorized photographs from other users of the system,
- Publish photographs that are framed or that are illustrative photographs, and photographs containing any other distracting elements or photographs in unusual, broken format,
- Stating contact information (company name), URL links, prices and other information into the place designed for description of the property,
- Repeatedly send the same offers under different registration numbers,
- Change the price of the offer for any special purpose
13. The Operator is entitled to remove the advertisements from the Service without compensation and delete the advertisements without notice, when those advertisements contradict the intentions of the Operator.
14. The operator is not obliged to state criteria of sorting (relevance) the advertisements in the list of advertisements.
15. The Operator reserves the right to add a watermark Rushingit.com to the photographs attached to the advertisement.
16. The Operator reserves the right to suspend or terminate the Service to the Client, exclude the Client or the advertisements from the system, deny the Client or User the access to the Service, if there is a serious breach of any provision of these Terms and Conditions or due to repeated minor violations. This will be done without prior notice.
17. If there is any suspicion of duplicate advertisements, the Operator is entitled to suspend the advertisements (ie. two or more advertisements that will be evaluated as a duplicate) without any compensation.
18. Operator uses third-party advertising companies to serve ads when you visit our (Operator) Website. These companies may use information (not including your name, address, email address, or telephone number) about your visits to this and other websites in order to provide advertisements about goods and services of interest to you.
19. Operator collect and store the following personal information:
- contact information, e-mail address (only if Client or User create an account)
- statistic on page views, traffic to and from Rushingit.com and ad data.
- users IP address and other informations
20. We Use Cookies
Cookies are very small text files that are stored on your computer when you visit certain web pages that record your preferences. They cannot harm your computer and they do not contain any personal or private information.

DISCLAIMER OF WARRANTIES. CLIENT / USER AGREES THAT USE OF RUSHINGIT.COM IS AT HIS/HER SOLE RISK. RUSHINGIT.COM EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
